Frequently asked questions

What forms of divorce exist in Morocco?

The Moudawwana provides for divorce by mutual consent, Talaq (regulated repudiation), Khul' (divorce at the wife's initiative) and divorce for discord (Chiqaq). Each form follows its own procedure.

How is child custody decided?

The judge is guided by the best interests of the child. Custody is generally granted to the mother, absent particular circumstances. The father retains visiting rights and contributes to the child's upkeep.

Can a maintenance award be varied?

Yes. If financial circumstances change (unemployment, remarriage and so on), you can apply to the court to have the maintenance increased or reduced.
